Wayne Waite A Life of Service and Integrity
Greene County Magistrate Wayne Waite has practiced law for more than 43 years. He is licensed to practice law in all Ohio Courts. He is also admitted to practice in the United States District Court for the Southern District of Ohio, the United States 6 Circuit Court of Appeals, and the Supreme Court of the United States. He has taken depositions nationally and has handled cases in Nebraska, and Illinois. He has handled international matters in the Philippines, Sweden, and Honduras.
Married nearly fifty years to Dr. Christina Waite, a psychiatrist and Director of Psychiatry at Miami Valley Hospital, Wayne has gained unique insight into cognition, capacity, and vulnerability from their shared life.
Wayne earned a psychology degree cum laude from the State University of New York at Potsdam, and a law degree cum laude from the University of Dayton School of Law. There, he served on Law Review, worked in the legal clinic, and interned with the City of Kettering Law Department.
Wayne launched his 43-year legal career in healthcare, serving as corporate counsel for Miami Valley Hospital and later as Vice President of Human Resources and General Counsel for Fidelity Health Care. In these positions, he collaborated with physicians and administrators, on patient rights, compliance, and fiduciary duties. Early involvement in probate competency hearings and emergency hospitalization proceedings deepened his understanding of capacity, risk, and the need for judicial restraint when individual liberties are involved.
Wayne’s private practice includes the prominent firms- Bieser, Greer and Landis; Freund, Freeze and Arnold; Poling Law; and Waite, Tomb and Eberly—Wayne handled probate litigation, estate administration, guardianships, fiduciary disputes, healthcare law, business litigation, including jury trials. He represented individuals, families, nonprofits, healthcare systems, and long-term care providers, often in emotionally charged matters demanding sound judgment and discretion. He has filed probate cases in more than 15 Ohio counties. He was trusted as the treasurer for Freund, Freeze and Arnold for over ten years.
In September 2025, Wayne transitioned to the bench as a Magistrate with the Greene County Common Pleas Court. In this role, he conducts hearings, assesses evidence, applies the law, and issues findings impacting families and personal rights—drawing directly on decades of practical legal and fiduciary experience.
Wayne’s service reaches far beyond Ohio. In 1996, he and Christina co-founded Shoulder to Shoulder, Inc., a nonprofit providing healthcare, education, and nutrition in rural Honduras. Under his leadership, the organization has provided health care for over seventy thousand people yearly, through enduring partnerships with governments and international donors.
Wayne has also taught Aviation Law as an adjunct professor at Sinclair Community College and holds a private instrument-rated pilot license. He is also certified SCUBA diver. Wayne and Christina reside in Xenia Township, Ohio, with one son and three grandchildren, staying active in church and community.
